1. Agreement to these terms
These Terms of Service ("Terms") govern your use of the Mentra iOS app and related services ("Mentra," "the Service"), operated from Thailand. By creating an account or using Mentra, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
2. What Mentra is
Mentra pairs with a physical recording device to capture sales calls and meetings, transcribes them, gives live AI-generated suggestions during the call, and produces a structured note afterward. It's a tool to help you run and document conversations - it does not replace your own judgment, and its AI output can be wrong.
3. Your account
- You must provide accurate information and keep your login credentials secure.
- You're responsible for everything that happens under your account.
- You must be at least 18 to use Mentra.
- You can delete your account at any time from Settings.
4. Recording other people is your responsibility
Mentra records the other party on your calls. You, not Mentra, are responsible for knowing and following the recording-consent laws that apply to each call - these vary by country and sometimes by state or region, and some places require every participant's consent, not just yours. Mentra shows a reminder before recording starts, but that reminder does not fulfill your legal obligation.
You agree not to use Mentra to record anyone in a way that violates applicable law, and you agree to indemnify us against claims arising from your failure to obtain any consent required for a recording you made.
5. Acceptable use
You agree not to:
- Use Mentra for any unlawful purpose, including recording someone without legally required consent
- Attempt to reverse-engineer, disrupt, or gain unauthorized access to the Service
- Resell or provide the Service to others as your own product
- Upload content to your knowledge base that you don't have the rights to use
6. AI output & accuracy
Transcripts, live suggestions, summaries, and next steps are generated by third-party AI models and speech-recognition services. They can be incomplete, out of date, or wrong - including the "directional" answers Mentra gives when it isn't confident enough for a direct answer. You're responsible for verifying anything important before relying on it or repeating it to a customer.
7. Your content
You keep ownership of your call recordings, transcripts, notes, and knowledge base content. By using Mentra, you give us the limited right to process that content through the providers listed in our Privacy Policy, solely to provide the Service to you.
8. Intellectual property
Mentra, its logo, and its software are owned by us and protected by intellectual property law. These Terms don't grant you any rights to our brand or code beyond using the app as intended.
9. Disclaimer of warranties
Mentra is provided "as is." We don't guarantee the Service will be uninterrupted, error-free, or that AI-generated content will be accurate. Recording depends on your device's Bluetooth connection and battery, both outside our control.
10. Limitation of liability
To the extent permitted by law, Mentra is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including lost sales, lost data, or legal consequences from a recording you made.
11. Termination
We may suspend or terminate your account if you violate these Terms, including using Mentra to record someone unlawfully. You can stop using Mentra and delete your account at any time.
12. Governing law
These Terms are governed by the laws of Thailand, without regard to conflict-of-law principles. Any dispute will be resolved in the courts of Thailand, unless applicable local consumer-protection law in your own country requires otherwise.
13. Changes to these terms
We may update these Terms from time to time. We'll update the "last updated" date above, and for significant changes, notify you in the app.

2. Mentra คืออะไร
Mentra จับคู่กับอุปกรณ์บันทึกเสียงจริงเพื่อบันทึกการโทรขายและการประชุม ถอดความเป็นข้อความ ให้คำแนะนำสดจาก AI ระหว่างการสนทนา และสร้างบันทึกที่มีโครงสร้างหลังจบการสนทนา เป็นเครื่องมือช่วยให้คุณดำเนินและบันทึกบทสนทนา แต่ไม่ได้แทนที่วิจารณญาณของคุณ และผลลัพธ์จาก AI อาจผิดพลาดได้
3. บัญชีของคุณ
- คุณต้องให้ข้อมูลที่ถูกต้องและรักษาความปลอดภัยของข้อมูลเข้าสู่ระบบ
- คุณรับผิดชอบต่อทุกกิจกรรมที่เกิดขึ้นภายใต้บัญชีของคุณ
- คุณต้องมีอายุอย่างน้อย 18 ปีจึงจะใช้ Mentra ได้
- คุณสามารถลบบัญชีได้ทุกเมื่อจากหน้าตั้งค่า
4. การบันทึกเสียงผู้อื่นเป็นความรับผิดชอบของคุณ
Mentra บันทึกเสียงคู่สนทนาของคุณด้วย คุณ ไม่ใช่ Mentra เป็นผู้รับผิดชอบในการทราบและปฏิบัติตามกฎหมายเรื่องการขอความยินยอมในการบันทึกเสียงที่ใช้กับการโทรแต่ละครั้ง ซึ่งแตกต่างกันไปในแต่ละประเทศและบางครั้งแตกต่างกันไปตามรัฐ/พื้นที่ บางแห่งกำหนดให้ต้องได้รับความยินยอมจากทุกฝ่าย ไม่ใช่แค่คุณ Mentra จะแสดงข้อความแจ้งเตือนก่อนเริ่มบันทึกเสียง แต่ข้อความนี้ไม่ได้ทำให้คุณพ้นจากหน้าที่ตามกฎหมาย
คุณตกลงจะไม่ใช้ Mentra บันทึกเสียงผู้ใดในลักษณะที่ฝ่าฝืนกฎหมายที่ใช้บังคับ และตกลงจะชดใช้ค่าเสียหายแก่เราจากข้อเรียกร้องที่เกิดจากการที่คุณไม่ได้ขอความยินยอมที่กฎหมายกำหนดสำหรับการบันทึกเสียงที่คุณทำ
5. การใช้งานที่ยอมรับได้
คุณตกลงจะไม่:
- ใช้ Mentra เพื่อวัตถุประสงค์ที่ผิดกฎหมาย รวมถึงการบันทึกเสียงผู้อื่นโดยไม่ได้รับความยินยอมตามที่กฎหมายกำหนด
- พยายามถอดรหัสย้อนกลับ รบกวน หรือเข้าถึงบริการโดยไม่ได้รับอนุญาต
- ขายต่อหรือให้บริการนี้แก่ผู้อื่นในฐานะผลิตภัณฑ์ของคุณเอง
- อัปโหลดเนื้อหาลงในฐานความรู้ที่คุณไม่มีสิทธิ์ใช้งาน
6. ผลลัพธ์จาก AI และความถูกต้อง
ข้อความถอดเสียง คำแนะนำสด สรุป และขั้นตอนถัดไป ถูกสร้างขึ้นโดยโมเดล AI และบริการรู้จำเสียงพูดของบุคคลที่สาม ซึ่งอาจไม่ครบถ้วน ล้าสมัย หรือผิดพลาดได้ รวมถึงคำตอบ "แนวทาง" ที่ Mentra ให้เมื่อไม่มั่นใจพอที่จะตอบโดยตรง คุณมีหน้าที่ตรวจสอบข้อมูลสำคัญก่อนนำไปใช้หรือแจ้งต่อลูกค้า
7. เนื้อหาของคุณ
คุณยังคงเป็นเจ้าของเสียงบันทึกการโทร ข้อความถอดเสียง บันทึก และเนื้อหาฐานความรู้ของคุณ การใช้ Mentra ถือว่าคุณให้สิทธิ์แบบจำกัดแก่เราในการประมวลผลเนื้อหานั้นผ่านผู้ให้บริการที่ระบุไว้ในนโยบายความเป็นส่วนตัวของเรา เพื่อวัตถุประสงค์ในการให้บริการแก่คุณเท่านั้น
8. ทรัพย์สินทางปัญญา
Mentra โลโก้ และซอฟต์แวร์เป็นทรัพย์สินของเราและได้รับความคุ้มครองตามกฎหมายทรัพย์สินทางปัญญา ข้อกำหนดนี้ไม่ได้ให้สิทธิ์ใด ๆ แก่คุณในแบรนด์หรือโค้ดของเรา นอกเหนือจากการใช้แอปตามวัตถุประสงค์ที่กำหนด
9. ข้อจำกัดความรับผิดชอบ
Mentra ให้บริการตามสภาพ "ที่เป็นอยู่" เราไม่รับประกันว่าบริการจะไม่หยุดชะงัก ปราศจากข้อผิดพลาด หรือเนื้อหาที่สร้างโดย AI จะถูกต้องเสมอ การบันทึกเสียงขึ้นอยู่กับการเชื่อมต่อบลูทูธและแบตเตอรี่ของอุปกรณ์ของคุณ ซึ่งอยู่นอกเหนือการควบคุมของเรา
10. ข้อจำกัดความรับผิด
เท่าที่กฎหมายอนุญาต Mentra จะไม่รับผิดต่อความเสียหายทางอ้อม ความเสียหายที่เกิดขึ้นโดยบังเอิญ หรือความเสียหายที่เป็นผลสืบเนื่อง อันเกิดจากการใช้บริการของคุณ รวมถึงยอดขายที่สูญเสีย ข้อมูลที่สูญหาย หรือผลทางกฎหมายจากการบันทึกเสียงที่คุณทำ
11. การยกเลิก
เราอาจระงับหรือยกเลิกบัญชีของคุณหากคุณฝ่าฝืนข้อกำหนดนี้ รวมถึงการใช้ Mentra บันทึกเสียงผู้อื่นโดยผิดกฎหมาย คุณสามารถหยุดใช้งานและลบบัญชี Mentra ได้ทุกเมื่อ
12. กฎหมายที่ใช้บังคับ
ข้อกำหนดนี้อยู่ภายใต้บังคับกฎหมายไทย โดยไม่คำนึงถึงหลักขัดกันแห่งกฎหมาย ข้อพิพาทใด ๆ จะได้รับการพิจารณาในศาลไทย เว้นแต่กฎหมายคุ้มครองผู้บริโภคในประเทศของคุณกำหนดไว้เป็นอย่างอื่น
13. การเปลี่ยนแปลงข้อกำหนดนี้
เราอาจปรับปรุงข้อกำหนดนี้เป็นครั้งคราว โดยจะอัปเดตวันที่ "แก้ไขล่าสุด" ด้านบน และแจ้งให้ทราบในแอปสำหรับการเปลี่ยนแปลงที่สำคัญ
